these terms and conditions were last updated on october 28, 2015

by accessing and using this website , you accept and agree to be bound by the terms and provision of this agreement. in addition, when using this website's particular services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. all such guidelines or rules are hereby incorporated by reference into the terms and conditions.

ANY PARTICIPATION IN THIS SITE WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT. IF YOU DO NOT AGREE TO ABIDE BY THE ABOVE, PLEASE DO NOT USE THIS SITE. (we used caps, and if you've played around on the site, you know we hate capitals. that means it's serious.)

1. liability

information/site usage: nestment strives to provide accurate information throughout our site and any interactions outside of the site, such as social media or email correspondence. however, nestment llc shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information. nestment shall not be responsible for any negative outcomes of decisions that were made based on any comments or advice from nestment.

real estate transactions: nestment is a third party matchmaking service for real estate professionals and clients. we do our due diligence by checking four references per agent, meeting agents in person or via video chat, and reviewing a list of past transactions. however, we are not liable for any damage related to an unexperienced agent who falsified their application. our users are responsible for also doing their due diligence before using the services of any of the agents we recommend.

nestment shall not be held liable for any damages as a result of using an agent we recommended. agents are third parties and are not employed by nestment. the agent and their broker shall be held solely responsible for any issues that arise from the use of their services.

safety: nestment does its best to protect the consumer's safety by reference checking and interviewing agents. however nestment shall not be held liable for any actions of the third party real estate professionals we recommend. with regards to agent's safety, nestment does not screen or endorse any of the clients we connect agents to. it is up to the agent to behave in a way that they feel protects themselves when dealing with the general public. agents should in no way behave different with a nestment client than they would with the general public in regards to safety protocol.

2. privacy

nestment provides a detailed privacy policy. we strive to adhere strictly to this policy and take our users' privacy very seriously. continued use of this site is considered acceptance of this privacy policy.

3. intellectual property

nestment llc is the owner of all of the information available on our site unless otherwise noted. user agrees not to replicate any of our information without proper permission and credit.

4. users

nestment users must be 18 years or older and legal residents of the united states of america. users must operate in an honest capacity with nestment. they must actually be interested in connecting with a real estate professional for services involving real estate. users of the "find my agent" page may not be other real estate professionals who intend to obtain information about nestment. users of the "find my agent" page must also not use the site to obtain contact information of real estate professionals for purposes outside of their professional services (including but not limited to solicitation of agents for other referral services).

5. agent rules and expectations

any agent who agrees to work with a nestment client must strictly adhere to the following rules:

agents must treat the personal information of clients received from nestment in a way that complies with our privacy policy.

agents may never sell any information from nestment to third parties.

agents may never give a nestment referral to another agent. the agent who receives the referral is the only agent who may work with the client unless prior approval from nestment was obtained.

agents may not use nestment's name for their own advertising purposes.

agents will reach out to referral client via email and/or phone within 24 hours of receiving information from nestment.

agents agree to pay nestment, through CA licensed real estate salesperson caitlin salvatore, a 25% referral fee upon the closing of referrals sent to them by nestment. agents may receive contact information for referral client before referral paperwork is complete. nestment operates under good faith that agents will cooperate with the 25% referral fee policy regardless of timing of the referral paperwork.

agents will give referral buyer clients thorough buyer consultations prior to touring any homes. 

agents will preview each home prior to touring the home with referral clients. this policy is flexible in very competitive seller’s markets if a listing hit the market within the last 48 hours.

nestment expects agents to communicate openly with nestment throughout transactions. 

if referral clients are unresponsive, prior to initial consultations, nestment expects agents to reach out a maximum number of 4 times before notifying nestment. at that time, nestment will instruct agents how to proceed.

nestment allows referral clients to discontinue working with agents after the initial consultation. nestment expects agents to respect this and cease communication with referral clients if this occurs.

nestment reserves the right to decline to accept agents into their database and will not disclose the reason.

nestment makes no guarantee, even after acceptance into the database, to send agents referral clients.

it is the agent's responsibility to notify nestment if my production falls below 30 homes in the last 3 years.
